1. Acceptance of Terms

By downloading, installing or using the Circadian app ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms supplement, and do not replace, the Apple Media Services Terms and Conditions and the Licensed Application End User Licence Agreement ("Apple Standard EULA") available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict, these Terms prevail to the extent permitted by Apple's requirements.

2. Description of Service

Circadian is a science-backed alarm clock application that provides alarm functionality, wake-up missions, sound modes, personalised sleep schedule recommendations and sleep tracking. The App is provided by Moment Apps ("we", "us", "our").

3. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent that you meet this age requirement.

4. Account

When you first use the App, an anonymous account is created automatically to enable core functionality such as wake-up mission verification and feedback submission. No email address, password or personal identifiers are required. You are responsible for maintaining the security of the device on which this account resides.

5. Device Permissions

Certain features require access to device capabilities. You may revoke any permission at any time through your device Settings, though doing so may affect functionality.

6. AI-Assisted Photo Verification

Wake-up missions require you to take a photo to verify task completion. These photos are transmitted to a server-side function and processed using OpenAI's Vision API, a third-party artificial intelligence service, to determine whether the mission criteria have been met. The verification result (accepted or rejected) is returned to the App; the photo itself is not stored after processing. By using the mission feature, you consent to this processing. If the verification service is unavailable, the mission is automatically accepted so that you can dismiss your alarm.

7. Subscriptions and Payments

7.1 Subscription plans

The App offers subscription-based access to premium features, billed through the Apple App Store. Current plans are displayed on the paywall screen within the App and may include monthly and annual options. All prices are set in App Store Connect and displayed in your local currency.

7.2 Free trial

We may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically renew and convert to a paid subscription at the rate shown at the time of sign-up. You will be charged through your Apple ID account.

7.3 Auto-renewal

Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the current period ends. You can manage or cancel your subscription at any time in your Apple ID account settings (Settings > Apple ID > Subscriptions).

7.4 Refunds

Refunds are handled in accordance with Apple's refund policy. We do not process payments or refunds directly.

8. Intellectual Property

All content, design, sounds, code and materials within the App are owned by Moment Apps or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer or create derivative works from any part of the App.

The App provides general sleep and wake-up recommendations based on published sleep science research. It is not a medical device and does not provide medical advice, diagnosis or treatment. The sleep plans, schedules and sounds offered are for general wellness purposes only. If you have a sleep disorder, medical condition, or are taking medication that affects sleep, consult a qualified healthcare professional before relying on the App's recommendations or changing your sleep routine.

11. Alarm Reliability

The App's alarm functionality depends on Apple's AlarmKit framework and your device's operating system. While alarms are designed to sound through Silent Mode and Do Not Disturb, Moment Apps does not guarantee that alarms will fire in every circumstance. Factors outside our control — including but not limited to device power state, operating system updates, system resource constraints and third-party software — may affect alarm delivery. You should not rely on the App as your sole alarm for safety-critical situations (e.g., catching flights, medical appointments) without a backup.

12. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Moment Apps disclaims all warranties, whether express, implied or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

To the fullest extent permitted by law, Moment Apps shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the App, including but not limited to damages arising from missed alarms, reliance on sleep recommendations, or loss of data. Our total aggregate liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid to us for the App in the 12 months preceding the claim, or £50, whichever is greater.

14. Indemnification

You agree to indemnify, defend and hold harmless Moment Apps, its officers, directors and agents from and against any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections 8, 10, 12, 13, 14, 16, 17 and 20 survive termination.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer under applicable law.

We may update these Terms from time to time. We will notify you of material changes through the App or by other reasonable means. Continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree with any changes, you should stop using the App.

20. Apple App Store Additional Terms

The following terms apply to your use of the App when downloaded from the Apple App Store. These terms are required by Apple and supplement the rest of these Terms.

20.1 Acknowledgement

These Terms are between you and Moment Apps only, and not with Apple Inc. ("Apple"). Moment Apps, not Apple, is solely responsible for the App and its content.

20.2 Scope of Licence

Moment Apps grants you a non-transferable, non-exclusive licence to use the App on any Apple-branded device that you own or control, subject to the Usage Rules set out in the Apple Media Services Terms and Conditions. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

20.3 Maintenance and Support

Moment Apps, not Apple, is responsible for providing any maintenance and support services for the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

20.4 Warranty

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Moment Apps' sole responsibility.

20.5 Product Claims

Moment Apps, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation.

20.6 Intellectual Property

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Moment Apps, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.

20.7 Legal Compliance

You represent and warrant that: (a) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties.

20.8 Third-Party Terms

When using the App, you must comply with any applicable third-party terms of agreement. For example, you must not be in violation of your wireless data service agreement when using the App.

20.9 Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
